What is an Expungement?
Normally, when you are convicted of a crime, that criminal record will follow you forever. However, there are some instances under South Carolina law where your criminal record can be destroyed. “Expungement” is the legal process where an individual petitions the Court to order all criminal records relating to a South Carolina arrest be erased. This can be important if you are applying for jobs, housing, or even educational opportunities. If your petition is granted, a Court is essentially ordering that all records of your arrest be “expunged,” destroyed or erased. Furthermore, you may legally deny the existence of the arrest and the existence of the expunction order itself. However, there is an exception: if you are questioned in a criminal proceeding, you may not deny the arrest, but you may say that the matter in question has been expunged.
